Legal notice

Preamble

These general terms and conditions of sale govern exclusively the contractual relations between any user of the site www.naminoe.fr (hereinafter referred to as a "User") and the merchant naminoe.fr belonging to the company Sophie Gaubert, whose head office is located at the following address: 23 rue de Bezons 92000 Nanterre (hereinafter referred to as Naminoe) whose fiscal identification is 51807382000046.

Naminoe may occasionally modify some of the provisions of its general conditions. These modifications are opposable from the moment they are put online and cannot be applied to contracts concluded previously. Each purchase on the Site is governed by the general conditions applicable at the date of the order.

The Site allows Naminoe to offer for sale art prints and/or illustrations, manufactured by and/or for Naminoe or its possible commercial partners (hereinafter referred to as the "Products") to users of the site www.naminoe.fr.

 

Acceptance of the conditions
 The present conditions can be consulted at any time by the Customer by clicking on the general sales conditions section. 

Consequently, the Customer acknowledges having read, at the time of placing his order, the special conditions of sale stated on this screen and expressly declares to accept them without reservation. 

The general conditions of sale will prevail over any other conditions appearing in any other document.

 

 

 

Capacity to contract
 The Customer guarantees that he/she is fully entitled to use the bank card he/she is using, that it is a personal card and that it is not a fraudulently used card. 

The Customer must declare to be at least eighteen years old and to have the legal capacity, or to be the holder of a legal authorization, allowing him/her to access and purchase online. Naminoe.fr reserves the right to refuse an order from a Customer with whom there is a dispute.

 

Products
 The photographs representing the objects are the most faithful but cannot ensure a perfect similarity with the product offered. They have no contractual value. Naminoe.fr takes the greatest care to put information on line including a complete description of the articles. 

However, in case of errors, Naminoe.fr cannot be held responsible. 

In order to constantly improve its services, Naminoe invites the Customer to inform it of any errors he may have noticed through the Contact section. The Customer who is not satisfied with the conformity of the delivered goods with the description made on the website, can exercise the right of withdrawal within 14 days as defined in article 7.

 

4- Availability

We will honor the order within the limits of our available stocks. 

In the event that one of the products ordered is not available in our stocks, we undertake to contact the user by e-mail within a maximum of 5 days from the date of your order in order to inform him/her of this and to indicate the time frame in which this product could, if applicable, be delivered to you. The user will then be able to either maintain his order or cancel it.

 

Payment
All the prices are indicated in Euros including all taxes.

Payments are made online by credit card and are fully secure through the PAYPAL platform.

You are not obliged to create a Paypal account to make your payment, but you can of course choose to use it if you have one.

Payment in several times with Alma.
If you pay your order in several times, you accept the general conditions of Alma's customers as well as the special conditions of Alma for Sophie Gaubert's customers.

A method of payment in cash, by check or by bank transfer can be accepted subject to prior request to: naminoestream@gmail.com

In accordance with the European Directive 2000/31/EC on certain aspects of electronic commerce, the placing of an order implies acceptance by the client of the contract and the definitive acceptance by the client of the prices and the description of the products available for sale as well as all the general conditions of sale.

 

Delivery
Once your order has been registered, it will generally be shipped within 2 to 5 working days (Paypal will send you a confirmation / on our side an email will be sent to you the day of the shipment).

All orders are shipped from Nanterre or Paris, by La Poste in Lettre suivi or Colissimo for France. On request, at the time of purchase, a hand delivery can be possible in Paris intro-muros and according to the period a hand delivery at the workshop of Nanterre.

The costs are indicated to you before the payment in the detail of your shopping cart. The delivery time is normally 2 to 5 working days for France, from the confirmation. International deliveries are made by Colissimo and the delay is variable, from one week to 15 days, approximately.

Naminoe declines all responsibilities related to possible delays, thefts, losses or deteriorations of the parcel by the Post Office.

 

Return, exchange, refund
In accordance with the French Consumer Code on distance selling (articles L121-16 and following of the Consumer Code), you have the right to withdraw from the contract without having to justify any reason, without penalty, only the return costs being at your charge. The law provides that the buyer of a product has a period of 14 working days from delivery. If this period normally expires on a Saturday, Sunday or public holiday, it is extended to the next working day.

After this deadline, Naminoe will be free to refuse the exchange or refund.

The exchange or refund of the items can only be accepted if the ordered items are returned to us in perfect condition, not worn, not washed, not soiled, not damaged.

The right of withdrawal is excluded for a product manufactured at the request of the consumer or personalized.

 

Litigation and disputes
Without prejudice to the guarantees set out in Article 8 below, the user has the opportunity to report by mail to snaminoestream@gmail.com, any claim relating to the following criteria:

* Product not received: within 21 days from the date of shipment of the Product, the Product has not been received by the user.

* Product not in conformity: within 3 days from the date of receipt of the Product, the Product received does not correspond to the Product ordered.

* Damaged product: within 3 days from the date of receipt of the product, the product received is damaged or broken.

Disputes are directly settled between the user and Naminoe. The user and Naminoe will make their best efforts to reach an amicable resolution of the dispute.

Depending on the case, the declared dispute will either result in the return of the ordered Product or in a refund.

Only items returned in their original packaging will be accepted.

You will be responsible for the return shipping costs, but you will not be charged for the exchange.

In accordance with the French law of January 6, 1978, you have the right to access, rectify, modify and delete your personal data. Naminoe commits itself not to disclose to third parties the information communicated.
